We provide a platform that enables you to create a presentation fingerprint, share it within and, if you choose, outside your organization, creating a network of presentation content and styles. This Privacy Policy applies to our platform, our website www.prezent.ai (the “Website”), as well as any related services, sales, marketing, or events (collectively, the “Services”).

In this Privacy Policy, we explain what information we collect, how we use it, and what rights you have in relation to it. Our Services are intended for representatives of businesses, and are not intended for consumers. Accordingly, we treat all personal information covered by this Privacy Policy as pertaining to individuals acting as business representatives, rather than in their personal or household capacity.

Please read this Privacy Policy carefully as it will help you understand what we do with the information that we collect.

1. What Information Do We Collect?

Personal information you disclose to us

The personal information we collect from you may include the following:

  • Contact and account information, such as names, email addresses, company names.
  • Preferred presentation style, including information about your preferred slide format and presentation structures, based on responses you provide to our questionnaire. We use this information to create your personalized presentation fingerprint and archetype.
  • Feedback or correspondence, such as information you provide when you contact us with questions, feedback, product reviews, or otherwise correspond with us online.
  • Marketing information, such as your preferences for receiving communications about our activities and publications, and details about how you engage with our communications.

Information we collect automatically

We automatically collect certain information when you use our Services. The information we collect includes:

  • Log and Usage Data. Log and usage data are service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings, and information about your activity on the Services (such as the date/time stamps associated with your usage, pages, and files viewed, searches and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called ‘crash dumps’) and hardware settings).
  • Device Data. We collect device data such as information about your computer, phone, tablet, or another device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.
  • Location Data. We collect location data such as information about your device’s location, which can be either precise or imprecise. How much information we collect depends on the type and settings of the device you use to access the Services. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). You can opt out of allowing us to collect this information either by refusing access to the information or by disabling your Location setting on your device. Note, however, if you choose to opt out, you may not be able to use certain aspects of the Services.

Information collected from other sources

We may obtain information about you from other sources, such as public databases, joint marketing partners, affiliate programs, and data providers, as well as from other third parties. This information includes mailing addresses, job titles, email addresses, phone numbers, intent data (or user behavior data), Internet Protocol (IP) addresses, social media profiles, social media URLs, and custom profiles, for purposes of targeted advertising and event promotion.

Information you upload

We may obtain information automatically from your uploaded content. Some of our features are designed to allow you to upload, store, share and do more with your content. Note that you are under no obligation to provide any content to us. You are free to upload and share content of your choice, provided you have necessary rights, and content is lawful.

2. How Do We Use Your Information?

We use the information we collect or receive:

To provide and support the Services. We use your personal information to operate, maintain, and provide you with the Services pursuant to our contract with you, including to:

  • allow you to create and use an account;
  • create and display your profile and personalized presentation fingerprint and archetype;
  • allow you to browse the Services, view other presenters on the Service, and communicate with them; and
  • respond to your requests, provide customer support, contact you in case of any issue with your account, and send you announcements, updates, security alerts, and support and administrative messages. 

Improve, monitor, and protect our Services and communications. It is in our legitimate interests to improve and keep our Services safe for our users, which includes:

  • troubleshooting, testing and research and to keep the Services secure;
  • data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns, and evaluating and improving our Services and your experience;
  • investigating and protecting against fraudulent, harmful, unauthorized or illegal activity; and
  • providing customized Services and communications that may be relevant or of interest to you.

Marketing and advertising, including for:

  • Direct marketing. We may send you direct marketing communications as permitted by law, including, but not limited to, sending newsletters, and notifying you of special promotions, offers and events via postal mail, email, telephone, text message, and other means. 
  • Interest-based advertising. We engage our advertising partners, including third party advertising companies and social media companies, to advertise our Services. For more information, or to understand your choices, please visit our Cookie Policy
  • Testimonials. We post testimonials on our Website that may contain personal information. Prior to posting a testimonial, we will obtain your consent to use your name and the content of the testimonial. If you wish to update or delete your testimonial, please contact us at privacy@prezent.ai, and be sure to include your name, testimonial location, and contact information.

Where applicable, if you choose to subscribe to our marketing and advertising, we process your personal information based on your consent, which you may withdraw at any time.

To enforce our agreements, to comply with legal obligations and to defend us against legal claims or disputes. We may use your personal information in our legitimate interests to enforce and comply with our terms and policies, to ensure the integrity of our Services and to defend ourselves against legal claims or disputes. Some processing may also be necessary to comply with a legal obligation, for example to keep records of transactions, or as requested by any judicial process or governmental agency.

We will process your personal information based on our legitimate interests where such legitimate interests are not overridden by your interests or fundamental rights and freedoms.

3. Who Can See Your Profile, Presentation Fingerprint and Personal Preferences?

When you use the Services, your profile, presentation fingerprint, and personal preferences will be visible to other users of the Services as follows: 

  • If you create an account on the Services: Your presentation fingerprint and personal preferences will be visible to other users of your own organization, such as other colleagues from the company at which you work, to allow them to develop presentations better suited to your personal style. In addition, your profile and company name will be visible to all Prezent users, based on your “share” settings within the Services (as described below).
  • If you create a presentation fingerprint, but you have not created an account on the Services: The Services may allow users to request non-users to create a presentation fingerprint. If you receive a request and you create a presentation fingerprint but you do not subscribe for an account, your presentation fingerprint and personal preferences will be visible to the user who sent you the request and to members of your own organization who use the Services, such as other colleagues at the company at which you work.

Through your settings within the Services, you can adjust the audience for your presentation fingerprint and personal preferences, such as by selecting specific individuals outside your organization who can view your information or by making information available to all other users. For example, you may choose to share your fingerprint with customers or clients at a different organization to allow them to better tailor a presentation to you. You can control who can see such information using the “share” settings within the Services.

4. How Do We Share Your Information?

We also share personal information with the following categories of recipients:

Service providers. We may share your personal information with third party companies and individuals that provide services on our behalf or help us operate our Services (such as customer support, hosting, analytics, email delivery, marketing, identity verification, and database management).

Advertising partners. We may share your personal information with third party advertising companies, including for the interest-based advertising purposes described above.

Professional advisors. We may disclose your personal information to professional advisors, such as lawyers, bankers, auditors and insurers, where necessary in the course of the professional services that they render to us.

For compliance, fraud prevention and safety. We may share your personal information for the compliance, fraud prevention and safety purposes described above.

Business transfers. We may sell, transfer or otherwise share some or all of our business or assets, including your personal information, in connection with a business transaction (or potential business transaction) such as a corporate divestiture, merger, consolidation, acquisition, reorganization or sale of assets, or in the event of bankruptcy or dissolution. In such a case, we will make reasonable efforts to require the recipient to honor this Privacy Policy.

5. How Long Do We Keep Your Information?

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Policy unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). We generally retain your personal information for up to six (6) months past the termination of your user account, unless we are required to retain your information longer pursuant to our agreement with your organization, or otherwise to establish, protect, or defend legal rights.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

6. How Do We Keep Your Information Safe?

We have implemented technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security, and improperly collect, access, steal, or modify your information.

7. Children

We do not knowingly solicit data from or market to children under 18 years of age. By using the Website, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Website. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. 8. Privacy Rights and Choices

Advertising and marketing. We allow you to control the advertising and marketing you receive as follows:

  • Unsubscribe from direct marketing communications. You may opt out of marketing-related communications by following the opt out or unsubscribe instructions contained in the marketing communication we send you.
  • Online tracking opt-out. You can opt out of interest-based advertising as described in our Cookie Policy.  

Personal information requests. We may also offer you choices that affect how we handle the personal information that we control. Where required under the laws that apply in your place of residence, you may request the following in relation to your personal information: 

  • Information about how we have collected and used your personal information. We have made this information available to you without having to request it by including it in this Privacy Policy.
  • Access to a copy of the personal information that we have collected about you. Where applicable, we will provide the information in a portable, machine-readable, readily usable format.
  • Correction of personal information that is inaccurate or out of date.
  • Deletion of personal information that we no longer need to provide the Services or for other lawful purposes.
  • Additional rights, such as to object to and request that we restrict our use of your personal information, and where applicable, you may withdraw your consent.

To make a request, please email us as provided in the “Contact Us” section below. We may ask for specific information from you to help us confirm your identity. California residents can empower an “authorized agent” to submit requests on their behalf. We will require authorized agents to confirm their identity and authority, in accordance with applicable laws. You are entitled to exercise the rights described above free from discrimination.

Limits on your choices. In some instances, your choices and rights may be limited, such as where fulfilling your request would impair the rights of others, our ability to provide a service you have requested, or our ability to comply with our legal obligations and enforce our legal rights. If you are not satisfied with how we address your request, you may submit a complaint by contacting us as provided in the “Contact Us” section below. 

Do Not Track. Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit.  We currently do not respond to “Do Not Track” or similar signals. To find out more about “Do Not Track,” please visit http://www.allaboutdnt.com.

9. International Data Transfers

When you use our Services, you provide your information to us in the United States. We may transfer your personal information to the third parties described in this Privacy Policy, which may be in the United States or other countries that do not have the equivalent privacy laws to those that apply in your country of residence. In these instances, we will ensure that relevant safeguards are in place to afford adequate protection for your personal information and we will comply with applicable data protection laws, including by relying on an EU Commission or UK government adequacy decision or on contractual protections for the transfer of your personal information. 10. Do We Make Updates to This Policy?

We may update this Privacy Policy from time to time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. If we make material changes to this Privacy Policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this Privacy Policy frequently to be informed of how we are protecting your information.
